Information We Collect

This Privacy Notice describes how PayLane collects, uses, and shares personal information via its website and related services we provide (collectively, our “Services”) to individuals using our Service to make or direct payments (“Consumers”). Our Services include services that permit individuals to pay for goods and services by directing a portion of the deposit of their future paychecks. This Notice applies to information provided, transmitted, or submitted through our Services, and it also describes the choices we offer with respect to such data.  

 

We collect information you choose to give us and other information that may be automatically collected from your use of our Services, including from your device. We use that information to operate our business, and for a variety of other purposes set forth below.   

 

This Privacy Notice does not apply to third parties or their services. This Privacy Notice does not apply to information which cannot be identified to any individual, household, or their devices. This Privacy Notice does not describe the practices of business customers who use our Services to receive payments (“Merchants”); please refer to these Merchants’ notices to understand their practices. If you are a Consumer, then our Services interact with your employer or certain other third parties who may require you to accept terms or to whom you may direct us to share your data (“Supporting Third Parties”). We are not responsible for how these Supporting Third Parties use information provided via our platform; you should refer to them to understand their data use and/or privacy practices.  

To provide our Services, we collect data by which you may be personally identified. We may also collect information about the devices and equipment you use to access our Service, including your usage data. 

 

We collect this information from a variety of sources, including: 

  • Directly from you when you provide it to us, including when you use our Service. 

  • Directly from Merchants and other Supporting Third Parties with whom our Services interact. 

  • Automatically as you utilize the Service.  

  • From third parties, including analytics providers.  

 

Information directly from you. If you are a Consumer, the information we collect on or through our Service from you may include information that you provide directly to us including your first and last name, mailing address, phone number, email address, date of birth, Social Security Number, employer identity, bank account details, details about your pay frequency and amount, and other identifiers as necessary to provide our Services. We collect information provided at the time you fill out forms on our Service, sign up for emails and newsletters, or communicate with us. If there is an issue with providing our Services, we may collect additional information or require additional verification to troubleshoot the issue. 

 

Information from Merchants and Supporting Third Parties. If you are a Consumer, we may also collect your information when you provide it directly to the Merchant or Supporting Third Parties (including your employer or bank) when these parties provide this information to us regarding your transactions and your accounts with them. In particular, we may receive information about you from these parties when your transactions and accounts interact with our Services to support an intended payment. This information may include information listed above which we would otherwise collect directly from you.  

 

If you are a Merchant (or applying to be a Merchant) who uses our Service or makes it available to your consumers, we may collect information that you provide to us. This information may include individual and business information, such as first and last name, business identification number, taxpayer identification number, driver’s license number or other government-issued identification number, tax withholding allowances and tax filing status, information about products and services and your intended payment activities, and other identifying information or information about your suitability to be a Merchant using or making our Services available.  

 

Information we collect through automatic data collection technologies. As permitted by law, we reserve the right to collect data regarding your use of our Services through cookies, web beacons, and other automatically collected information. This data may include your IP address, date and time you access our Services and the pages and content you access during your visit, websites that you link to or from, emails from us that you open, and the links you click on within those emails. We may also collect information from your mobile device or your computer about how you interact with our Services, including IP address, operating system, and browser type. This information helps us address customer support issues, provide you with a personalized experience, prevent fraudulent use of our services, and manage the Services we provide you, including gathering aggregated data about engagement. Cookies are small identifiers sent from a web server that are stored on your device for the purpose of identifying your browser or storing information or settings in your browser. Cookies may also be used to personalize your visit by storing your preferences or displaying content based upon what you have viewed through our Services and other websites.  Web beacons or pixel tags connect web pages to web servers and their cookies. We and others may use these and similar technologies on our services and other websites.  

 

Other parties may collect personally identifiable information about your online activities over time and across third-party websites when you use our website or services. We do not respond to “do not track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across third-party websites or online services. 

 

Information we collect from third party sources. We may collect additional information from third-party analytic services who help us better understand our contacts, including advertisers, ad networks and servers, content providers, and application providers. These third parties may provide us information both in connection with our Services and through tools they use to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information about your online activities over time. They and we may use this information to provide you with interest-based advertising or other targeted content, and for other purposes (such as to better understand our Services’ audience). 

 

How We Use Information We Collect 

 

We may use data we collect for a variety of purposes, including the following: 

 

  • To provide, maintain, monitor, and improve our Services. If you are a Consumer, this use includes processing your transactions, permitting you to direct deposits of your future paychecks, and collecting fees from you. 

  • To assess suitability to be a Merchant, including whether applicants meet our anti-money laundering, “know your customer,” background checking and other compliance requirements. In addition, we use the data we collect from Merchants to fulfill obligations and to track, report on and display transaction history. 

  • To create, validate, and manage user accounts. 

  • To verify identity and account information.  

  • To support the compliance activity of our Supporting Third Parties. For examples, we may use and share information to support identity theft prevention, identify fraudulent or harmful ‘red flag’ activity, or address “know your customer” or similar rules to prevent money laundering or similar activity.   

  • To respond to inquiries, provide customer support and support dispute resolution. 

  • As permitted by law, we reserve the right to provide you marketing and promotional information about products and/or services you may be interested in and product and service updates. 

  • To allow our service providers to support our operations.  

  • To request user feedback and to improve user experience. 

  • To monitor and enforce our legal terms and similar conditions and policies. 

  • To comply with law and satisfy regulatory compliance obligations, including to comply with requests or requirements from government or regulatory authorities. 

  • To detect and prevent fraud and other prohibited, illicit or illegal activity.  

  • For other purposes permitted by law or to which you consent. 

 

Please note that we may combine the information we gather about you in identifiable form, including information from third parties. We may use this information, for example, to improve and personalize our services, content and advertising. 

 

How We Secure Information 

 

We maintain administrative, technical, and physical safeguards in an effort designed to protect against unauthorized access, use, modification, and disclosure of personal information in our control and custody. However, we note that no data security can be guaranteed. We do not control the security of third party systems, including those necessary to use our Services.  

 

How We Share Personal Information 

 

We may share your information with third parties as permitted or required by law, or as directed or authorized by you or other third parties. For example, we may disclose your information:  

 

  • With Merchants in our ecosystem to process your transactions, including reporting to the Merchant on the status of particular transactions and related activity.  

  • With Supporting Third Parties, which presently include, but is not limited to, Argyle, Dwolla, and Evolve Bank and Trust. These Supporting Third Parties may retain and use your information subject to their own terms and privacy practices. As noted above, this may include the use and sharing of your information to combat fraud or comply with anti-money laundering rules.  

  • With third party service providers who support our business including information technology and hosting vendors, and identity validation partners.  

  • With the billing providers of the applications our business users are linking to and as directed by that billing provider (such as with another third party if directed by customers). 

  • With our professional advisors who provide legal, compliance, accounting, banking, or consulting services. 

  • To comply with our legal obligations or to protect the interests, property or legal rights of you, ourselves, or third parties.  

  • With law enforcement, officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar law enforcement request, or when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of this Privacy Notice or other applicable terms. 

  • With companies or other entities in connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture or dissolution of all or a portion of our business.  

  • For other legal purposes, such as to enforce our legal terms, or to exercise or defend legal claims. 

  • With your direction or consent. 

 

Our service providers may require you to agree to separate terms and conditions and privacy notices.  

 

What Choices Do I Have? 

 

Update personal information. If you maintain an online account with us through our website, you can log in to that account to review and change certain information you have provided to us. 

 

Marketing communications. You may receive marketing information from us. You may opt out of receiving marketing emails, by following the unsubscribe link in each email, or by contacting us at (678) 722 5485. Please note that you may continue to receive non-marketing emails from us after you opt-out.   

You may opt out of receiving text messages from us by replying with the word “STOP” to any text message you have received or by changing your communications preferences by logging into your account and accessing your profile. 

 

Cookies. You have a number of choices regarding certain cookies. Most web browsers automatically accept cookies, but you may modify your browser’s setting to notify you of cookie placement or decline cookies. If you choose to decline cookies, certain features of our website may not function properly as a result.  

 

Updates to Our Privacy Notice 

 

We may update this Privacy Notice from time to time in order to provide clarification or notice of changes to our practices. If we make changes, we will revise the Effective Date at the top of this Privacy Notice. Changes to this Privacy Notice will be effective once they are posted on the site unless otherwise indicated.
